COBRA
Recently, it has come to our
attention that under New York State Law and employer is liable to offer
continuation of health insurance benefits under COBRA. This even applies
to employers with under 20 employees.
What this basically means is
that if you offer health insurance benefits to an employee, and that employee
leaves, you are responsible for informing them that they can continue their
health insurance benefits. You, the employer, would not be responsible
for payment; however, you must give them the option of continuing their
benefits. If the terminated employee chooses to continue the health
insurance coverage you are offering, your provider will bill them directly.
It has also come to our
attention that as an employer you should have in writing all benefit plans that
are available to your employees, whether you pay the premium or just offer the
benefit at the cost of the employee.
